Terms of Use

Please read this Terms of Use. By using TheArcLink Incorporated's ("TheArcLink") website, FindMyRoommate.org (the "Site"), and its services, you agree to be bound by the Terms of Use, as it may be modified from time to time. By continuing to use the Site after changes are made, you accept those changes. If you do not agree with the Terms of Use at any time, you should immediately stop using this Site. If you do not understand the Terms of Use ask someone who does to read and explain it to you.

You must verify information. You are responsible for making decisions concerning the housing situation of any individual. The Site is designed to help you to acquire information you need to make your decisions and to share information about yourself with others. You must verify any information you intend to depend upon. TheArcLink Incorporated does not guarantee the accuracy, completeness, or usefulness of the information presented on the Site. TheArcLink does not endorse the listings on the Site.
Your Registration Obligations. If you use the Site, you agree to: (a) provide true and accurate information about yourself in the registration form and elsewhere, and (b) promptly update your information to keep it true, accurate, current, and complete. You also consent to disclosure of your personal information included in your FindMyRoommate listing to third parties and the use of your information by us and third parties, as set forth in our then-current Privacy Policy, which is incorporated herein by reference, and which is available on the Site. No personal contact information (name, address, phone number, email address) is included in the public listings.
Personal and Non-Commercial Use Limitation. You may not use the Site for commercial purposes or your financial gain. You may not copy, distribute, transmit, display, frame, modify, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, including information about our members, software, products or services obtained from or as a result of the Site.
FindMyRoommates Message System. The Site contains a “message system” to allow contact between potential roommates without disclosing personal contact information. You acknowledge that disclosure of personal contact information via the message center is necessary for making a roommate match, but that once contact information is shared, TheArcLink and the state sponsors are not responsible for continued privacy of the information. You therefore agree that you will not share contact information you get from the message system with others, except those working on the specific roommate matching the messages concern. You cannot be absolutely certain that others will not share your information, so use caution in disclosing and learning contact information via the Site. Always use caution when giving out any personally identifying information about yourself or your family. TheArcLink is not liable for any information disclosed by you via the message system, or for information you gain via the message system.

Content on the Message System. TheArcLink does not routinely screen, edit, or review messages posted on the FindMyRoommate message system. You are solely responsible for your postings to the Message System and the consequences of any messages. TheArcLink reserves the right to monitor or remove any post, at any time, from the Site without notice. TheArcLink does not perform a background check on any user. We strongly recommend that individuals seeking roommates use the option of identifying a support person who will also receive copies of all messages and assist in deciding what information is to be shared. If at any time a user suspects that a listing or message is intended to mislead or harass, they should contact TheArcLink immediately. Such listings and messages will be removed pending investigation.
Your Obligations with Respect to Content. In distributing or posting your content and using the Site you agree not to: (a) infringe any copyright, patent, trademark, trade secret or other proprietary right or rights of publicity or privacy; (b) violate any applicable law or regulation; (c) make any harassing, defamatory or libelous comments; (d) be threatening, indecent, obscene or pornographic, (e) upload any files, macros, programs or the like which contain any viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that damage, detrimentally interfere with, surreptitiously intercept or expropriate any computer, system, data or personal information. By using the Site, you also agree not to distribute unsolicited commercial messages ("spam"), inappropriate or off-topic messages, or take any other action which imposes an unreasonable or large load on our infrastructure, such as bulk communications of any kind.

Linking to the Site. To link to the Site, you must read and comply with the following. A site that links to the Site:

Must ask TheArcLink for permission to link to its Site.
May link to, but not replicate, TheArcLink's content.
May not create a browser or border environment around the Site's content.
May not imply that TheArcLink is endorsing it or its products or services.
May not misrepresent its relationship with TheArcLink.
May not present false information about TheArcLink's content, products, or services.
May not use TheArcLink's name, logo, or the Site domain name without written permission from TheArcLink.
May not contain content inappropriate for all age groups or content that could be construed is distasteful, offensive or controversial.

Termination of Access. TheArcLink may terminate or suspend your access to the Site for any reason. Any suspected fraudulent, abusive, or illegal activities are possible grounds for termination. TheArcLink and state sponsors, employees or agents, shall not be liable to you or any third party for the termination of your membership or any claims related to the termination of your membership.
Liability disclaimer. You expressly agree that use of the Site is at your sole risk. The Site is provided on an "as is" and "as available" basis. TheArcLink expressly disclaims all warranties of any kind, express or implied, including without limitation, any warranty of merchantability, fitness for a particular purpose or non-infringement.

TheArcLink makes no representation or warranty that the Site will meet your requirements, or that your use of the Site will be uninterrupted, timely, secure, or error free; nor does TheArcLink make any representation or warranty as to the results that may be obtained from the use of the Site, the services, information or products obtained through or on the Site. TheArcLink will not be liable for any direct, indirect, consequential, or incidental damages, whether foreseeable or not, known or unknown, which may result from the unavailability or malfunction of the Site, the services, or information obtained through or on the Site.

Any material and/or data downloaded or otherwise obtained through the use of the Site is at your own discretion and risk. You will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data.

Links with Other Sites/Promotional Messages. TheArcLink is not liable for the content of any other site linked to or from the Site. If you link to another site outside TheArcLink, you leave the Site. If you decide to link to another site, you do so entirely at your own risk. TheArcLink may provide links from the Site to other sites, but this is done solely as a convenience to you and should not be interpreted as an endorsement of any content of any other site. TheArcLink makes no representation or warranty, express or implied, as to any such linked site including but not limited to any representations or warranties of the accuracy, ownership, validity, or legality of any content of a linked site.
Indemnification. You agree to defend, indemnify and hold harmless TheArcLink and its affiliates, representatives, officers, directors and employees from all liabilities, claims, costs and expenses, including attorney fees, that arise out of or in connection with your use of the Site, any violation of this Terms of Use, the infringement of any law, intellectual property or other right of any person or entity, or your posting, downloading or transmission of any communications or materials on the Site.
Remedies. In the event that TheArcLink determines, at its sole discretion, that you have breached any portion of this Agreement, or have otherwise demonstrated conduct inappropriate for the Site, TheArcLink may (a) warn you via e-mail that you have violated this Agreement; (b) delete any content provided by you or your agent(s) to the Site, (c) terminate your registration with or access to the Site; (d) notify and/or send content to and/or fully cooperate with the proper law enforcement authorities for further action; (e) take any other action which TheArcLink deems appropriate, or (f) exercise any other remedy available under this Agreement, at law or in equity. All rights are cumulative.
